These Terms of Sale (“ToS”) govern the contractual relationship between WEBFUL SAS, a simplified joint-stock company with a share capital of €2,500, registered with the Nantes Trade and Companies Register under number 993 924 349, with its registered office at 5 Grande Rue, 44520 Grand-Auverné (hereinafter “WEBFUL” or “the Provider”), and any individual or legal entity (“the Client”) subscribing to a paid Webful website analytics service plan.
These ToS apply to the exclusion of any other terms, unless otherwise agreed in writing by WEBFUL. Subscription to any plan implies full acceptance of these ToS by the Client.
WEBFUL reserves the right to amend these ToS at any time. The applicable version is the one in effect on the subscription date. Any substantial modification will be notified to the Client by email with a 30-day notice period.
WEBFUL offers several subscription plans designed for individuals, professionals, and web agencies. Available offers include:

All prices are expressed in euros, excluding VAT. VAT at the current rate (20%) is added. Prices may be updated at any time, subject to a 30-day notice by email to existing Clients. New prices do not apply to ongoing subscriptions until renewal.
Subscription to a Webful plan is carried out exclusively online through the Client’s personal account on webful.fr. The Client must create an account with accurate and up-to-date information.
The subscription process includes the following steps:
The Client acknowledges having read the ToS and ToU and having expressly accepted them by ticking the acceptance box prior to any subscription.
The order becomes final once payment is validated by the payment processor. The Client receives a subscription confirmation email containing a summary of the order and these ToS.
Acceptance Tracking: WEBFUL keeps timestamped proof of the Client’s acceptance, including the accepted version identifier, acceptance date and time, and a technical session identifier.
Subscription fees are expressed in euros before VAT. The applicable VAT (20%) is added to determine the final billed amount.
Billing occurs monthly on the subscription anniversary date. Payment is made by credit card (Visa, Mastercard, American Express) or SEPA direct debit. The Client authorizes WEBFUL to automatically debit their account each month.
WEBFUL may revise its prices at any time, with a 30-day email notice. The Client may cancel their subscription within this period if they refuse the new pricing.
In case of payment failure, WEBFUL may suspend access to the service after a reminder that remains unanswered for 8 days. Late penalties amounting to 3× the legal interest rate apply, plus a fixed €40 recovery fee.
Subscriptions are contracted for a one-month term and renewed tacitly each month. Subscriptions are non-binding: the Client may cancel at any time.
Termination becomes effective at the end of the current billing period. The Client may cancel through their dashboard or by emailing support@webful.fr. No prorated refund will be issued.
WEBFUL may terminate a subscription in case of serious breach by the Client, including fraudulent use, non-payment, or violation of the Terms of Use.
Data Deletion: Under GDPR, upon termination, personal data will be deleted within 30 days, unless legally required otherwise. Historical statistics may be preserved in anonymized and aggregated form to improve the service.
Under French consumer law (Articles L.221-18 et seq.), consumers (individuals not acting in a professional context) have a 14-day withdrawal period starting from subscription.
To exercise this right, the Client must notify WEBFUL by email at support@webful.fr or via the contact form. WEBFUL will process the refund within 14 days.
Waiver of Withdrawal: Under Article L.221-28, the Client acknowledges that service execution begins immediately (instant dashboard access) and expressly waives the right of withdrawal. Acceptance occurs at order validation.
The Client agrees to use the service in compliance with its purpose and with these ToS. It is strictly prohibited to:
- Modify or decompile the provided tracking code
- Install the script on a site they do not own or manage
- Use the service for fraudulent or illegal purposes
- Attempt unauthorized access to WEBFUL systems or other users' data
- Intentionally overload the servers or compromise service security
The Client is solely responsible for the use of the service and the data collected. They must comply with GDPR obligations, including informing their website visitors and obtaining consent where required.
The Client indemnifies WEBFUL against any third-party claim arising from improper use of the service.
WEBFUL provides the service “as is,” aiming for 99% annual uptime (excluding planned maintenance and force majeure). WEBFUL does not guarantee uninterrupted or error-free operation.
WEBFUL shall not be liable for indirect damages such as loss of revenue, clients, data, commercial harm, or missed opportunities. WEBFUL’s total liability is limited to the amount paid by the Client in the past 12 months.
WEBFUL implements reasonable security measures but cannot guarantee absolute protection against cyberattacks or circumstances beyond its control.
WEBFUL processes personal data in accordance with the GDPR. Details are available in the Privacy Policy.
The Client may exercise rights of access, rectification, deletion, limitation, portability, and objection by contacting dpo@webful.fr or by postal mail.
WEBFUL shall not be liable for failure to perform due to force majeure, including telecommunications outages, hosting failures, cyberattacks, natural disasters, or any circumstance beyond reasonable control.
Under Article L.612-1 of the French Consumer Code, consumer Clients may use a free mediation service for dispute resolution. The competent mediator is available at: www.economie.gouv.fr/mediation-conso.
In case of persistent disputes, the courts of Nantes shall have exclusive jurisdiction.
These ToS are governed by French law. They are written in French. In case of translation, only the French version is legally binding.
