Terms of Service

Article 1 - Purpose

These Terms of Service (hereinafter "ToS") define the terms and conditions of access and use of the Webful service, a SaaS web analytics platform, accessible at webful.com, published by WEBFUL SAS, a simplified joint-stock company with a capital of EUR 2,500, registered with the Nantes Trade Register under number 993 924 349.

Use of the service implies full and complete acceptance of these ToS by the User.

Article 2 - Definitions

  • Service: Refers to the Webful platform accessible at webful.com and its web analytics features.
  • User: Any natural or legal person accessing the Service after creating an account.
  • Analyzed Site: User's website on which the Webful tracking script is installed.
  • Subscription: Contract concluded between WEBFUL and the User for paid access to the Service according to the pricing Plans described in the Terms of Sale.

Article 3 - Service Description

Webful enables its users to track their websites' traffic through:

  • A GDPR-compliant tracking script (no personally identifiable data collection)
  • A real-time analytics dashboard
  • Automated periodic reports
  • Automated SEO analysis (16 criteria)
  • PageSpeed Insights performance analysis
  • Conversion and custom event tracking

The Service is available in several pricing Plans detailed in our Terms of Sale: Free, Solo, Start, Pro, and Enterprise offers.

WEBFUL strives to ensure Service availability 24/7, except in cases of scheduled maintenance or technical incidents. An indicative availability rate of 99% per year is targeted, without contractual guarantee unless otherwise specified in Enterprise offers.

Article 4 - Registration and User Account

Access to the Service requires the creation of a free user account via the registration form on webful.com.

The User agrees to:

  • Provide accurate, current and complete information during registration
  • Maintain the confidentiality of their credentials (email and password)
  • Immediately inform WEBFUL of any unauthorized use of their account
  • Not create multiple accounts for the same user without authorization
  • Not assign, transfer or sell their account to a third party

WEBFUL reserves the right to refuse or suspend access to any account in case of violation of these ToS, false declaration or fraudulent use.

Article 5 - Data Collected and Protection

As part of registration and use of the Service, WEBFUL collects:

  • Account data: email address, name/surname (optional), hashed password
  • Site data: site name, URL, generated API key
  • Anonymized statistical data: pages visited, duration, referrers, device (mobile/desktop), browser, language
  • Billing data: for paid Plans, billing information and payment history

GDPR Compliance: WEBFUL collects NO personally identifiable data from visitors of Analyzed Sites. IP addresses are systematically hashed (SHA-256) before storage. No tracking cookies are placed on end visitors.

This data is used only for:

  • Operation and improvement of the Service
  • Generation of statistics and reports for the User
  • Communication with the User (support, automated reports if enabled)
  • Billing for paid Plans

No data is transmitted, assigned or sold to third parties, except for legal or judicial obligation.

Article 6 - Obligations and Prohibited Uses

The User agrees to:

  • Use the Service in accordance with these ToS and applicable law
  • Not use the Service for illegal, fraudulent purposes or infringing third-party rights
  • Install the Webful tracking script only on sites they own or have authorization for
  • Not attempt to bypass technical or pricing limitations of the Service
  • Not disrupt, compromise or attempt unauthorized access to WEBFUL systems
  • Respect the quotas and limitations of their subscription Plan

Strictly prohibited behaviors:

  • Script modification: altering, decompiling, reverse-engineering the Webful tracking script code
  • Unauthorized installation: installing the script on a site the User does not legitimately own or without explicit authorization
  • Unauthorized access attempt: attempting to access other users' data or WEBFUL internal systems
  • Deliberate overload: submitting massive or automated requests to saturate servers
  • Sabotage or attack: any action aimed at compromising Service security or availability

The User is solely responsible for the content of sites they analyze via Webful and must ensure compliance with applicable legislation (GDPR, etc.). In case of violation of these obligations, WEBFUL reserves the right to immediately suspend or terminate the User's account.

Article 7 - Liabilities and Limitations

7.1 WEBFUL's Liability

WEBFUL commits to implementing all necessary means to ensure quality Service. However, WEBFUL cannot be held liable for:

  • Temporary Service interruptions for scheduled maintenance (prior notification) or unforeseeable technical incidents
  • Consequences resulting from use or inability to use the Service
  • Data loss if the User does not follow backup recommendations
  • Indirect damages (loss of revenue, loss of customers, loss of opportunity)
  • Fraudulent use of User credentials if confidentiality was not maintained

Service Availability: WEBFUL may temporarily interrupt the Service for maintenance, improvement or anomaly correction, with or without notice depending on urgency. A 99% availability rate per year is targeted (excluding scheduled maintenance and force majeure).

In any case, WEBFUL's liability is limited to the total amount actually received by WEBFUL under the Subscription during the 12 months preceding the event giving rise to liability.

7.2 User's Liability

The User is solely responsible for their use of the Service and data they integrate. They indemnify WEBFUL against any third-party claims related to Service use or analyzed site content.

Article 8 - Data Ownership

Statistical data collected via the Webful script installed on User sites remains the exclusive property of the User.

WEBFUL commits to never sell, assign or transmit this data to third parties, except for legal or judicial obligation.

WEBFUL reserves the right to use aggregated and fully anonymized data (without any possible identification of the User or their visitors) for Service improvement, global statistics, research and development purposes. This aggregated data in no way allows identification of the User or visitors to their sites.

The User can export their data at any time from their dashboard or request complete deletion upon account termination.

Article 9 - Intellectual Property

The software, source code, design, logo, WEBFUL trademark and all Service elements are the exclusive property of WEBFUL SAS.

The WEBFUL trademark is registered with INPI under number 5193373 (October 27, 2025).

No total or partial reproduction, representation, distribution or reuse of the Service is authorized without prior written agreement from WEBFUL.

The User is granted a personal, non-exclusive and non-transferable right to use the Service, limited to the duration of their Subscription.

Article 10 - Duration, Suspension and Termination

10.1 Duration
These ToS are concluded for the duration of Service use by the User. For paid Plans, see billing and termination terms in the Terms of Sale.

10.2 Suspension by WEBFUL
WEBFUL reserves the right to immediately suspend access to the Service, without notice or compensation, in case of:

  • Violation of these ToS by the User
  • Non-payment of a paid Subscription after reminder
  • Fraudulent, abusive use or contrary to applicable laws
  • Request from judicial or administrative authority

10.3 Termination by the User
The User can delete their account at any time via their personal space settings. For paid Plans, termination takes effect at the end of the current subscription period (no pro-rata refund).

10.4 Consequences of Termination
Upon termination, access to the Service is immediately suspended. User data is retained for 30 days then permanently deleted, unless legal retention obligation.

Article 11 - ToS Modifications

WEBFUL reserves the right to modify these ToS at any time. Modifications take effect upon posting on the Site.

In case of substantial modification, WEBFUL commits to informing Users by email at least 15 days before new conditions come into effect.

Users who do not accept the new ToS have 15 days to terminate their account. Otherwise, continued use of the Service constitutes acceptance of the new ToS.

Article 12 - Applicable Law and Jurisdiction

These ToS are governed by French law.

In case of dispute relating to interpretation or execution of these terms, and failing amicable agreement, exclusive jurisdiction is granted to the courts of Nantes, France, regardless of plurality of defendants or warranty claims.

For consumer Users (natural persons acting for non-professional purposes), this clause does not preclude recourse before jurisdictions provided by consumer law.
